According to the postponement of the weekend planned by the Government of the Russian Federation, Saturday and Sunday, January 6 and 7, falling on the pre-holiday and holiday days, are postponed to March 9 and May 2, respectively. Two pre-holiday days - December 30 and 31 also fall on the weekend and will be non-working.

Thus, in January 2018, from the 31st calendar day, there will be 17 working days, while there will be 14 days off and holidays this month.

How the weekend was postponed in January 2018

Article 112 of the Labor Code of the Russian Federation provides that the postponement of days off is carried out in order to rationally plan working time in organizations and take into account the interests of various categories of citizens of the Russian Federation in creating conditions for a good rest.

For these purposes, Decree of the Government of the Russian Federation of October 14, 2017 No. 1250 “On the postponement of days off in 2018” provides for the following shift of days off:

from Saturday 6 January to Friday 9 March;
from Sunday 7 January to Wednesday 2 May.

Work on weekends and non-working holidays in January

By law work on weekends and non-working days holidays prohibited (Article 113 of the Labor Code of the Russian Federation). However, there are exceptions to this rule.

So, for example, it is allowed to involve an employee to work on a weekend / non-working holiday, if there is a need to perform unforeseen work, on the urgent implementation of which the further normal functioning of the organization depends.

In this case, the employee can be involved only with his written consent.

Note that sometimes engaging an employee on weekends/non-working holidays (including in January 2018) is possible without obtaining his/her consent.

For example, such situations include the involvement of an employee to prevent a catastrophe / industrial accident or eliminate the consequences of a catastrophe / industrial accident / natural disaster (Article 113 of the Labor Code of the Russian Federation).

How is work paid on weekends and non-working holidays in January 2018

Work on weekends, as well as non-working holidays, is payable at least twice the amount (Article 153 of the Labor Code of the Russian Federation).

The exact amount of wages for work on weekends / non-working holidays (including January 2018) can be specified in the collective agreement, local regulation or employment contract.

  • New Year holidays (from 1 to 8 January);
  • weekend for the Old New Year (January 13 and 14);
  • Saturday and Sunday after Epiphany (January 20 and 21);
  • weekend 27 and 28 January.

Thus, January will give us in January 2018 as many as 14 dates that fall into the category of "paid holidays"!

Who rests and who works on the January holidays?

The schedule proposed by the country's leadership is relevant for enterprises operating on a 5-day working week. This means that planning family vacations and trips for the winter vacation only employees of companies for which such a long stoppage of the workflow is possible.

emergency services, doctors, law enforcement, as well as employees of many other companies working on a daily or flexible schedule, will be forced to fulfill their duties regardless of how most fellow citizens rest.

Even if you usually work from Monday to Friday and according to all the rules you would have to rest until January 9, enjoying the promised holidays, such situations are possible:

  • By necessity. In this case, the employer will be able to call you to work only with written consent.
  • The threat of an accident, catastrophe, accident. In this case, the consent of the employee is not required. Moreover, you will have to come to the workplace as soon as possible.
  • Emergency situation, state of emergency (incident) at the enterprise. As in paragraph 2, the presence of the employee is required as soon as possible, regardless of his desire.

If you are in that small percentage of people who still have to be in the workplace on paid New Year holidays in 2018, be aware that Article No. 153 of the Labor Code of the Russian Federation obliges the employer to evaluate the work of an employee on holidays at a special rate.

How are holidays paid?

The Labor Code clearly states that work on public holidays must be paid at least twice the amount.

This rule applies to all employees, regardless of the form of payroll:

  • fixed rate;
  • piecework wages;
  • hourly pay, etc.

In some organizations, the amount of payments that will be accrued for paid holidays is set by a collective agreement so that employees do not have questions and doubts about what salary they will receive in January or May 2018 if they have to go on a day off.

Of course, in most cases, the issue of payment and reimbursement of working hours that fell on paid days in January 2018 is decided by the company's management, taking into account the specifics of the situation. If it is essential for an employee to get a day off, instead of double payment, he can receive a standard salary and an additional day off. It is worth noting that this form of compensation is allowed only at the request of the employee.

And finally one more important fact– the holiday starts at 00:00 and ends at 24:00. Therefore, when taking on daily duty from January 8 to 9, keep in mind that only work until midnight will be charged double.

January holidays 2019: how many days

The number of days off in January 2019 is fixed by the 112th article Labor Code RF. This norm determines how we relax in January 2019 and how long the official weekend lasts.

Non-working holidays (weekends) in January 2019 are:

On the weekend in January 2019, there are just 2 holidays - the 5th and 6th. These two additional days of rest are moved to May 2 and 3. Therefore, the May holidays will last for five whole days - from May 1 to May 5.

It turned out to be an interesting situation when the country, in fact, celebrated two New Years: according to the new and the old style. This explains the phenomenon of the "Old New Year".

For Europeans, this situation is paradoxical. However, our people are used to celebrating two New Years and see nothing out of the ordinary in this.

Moreover, in our country, Christmas is celebrated after the New Year - January 7th. However, the opposite is happening all over the world. In European countries, Christmas holidays are celebrated on December 25th.

In general, in our country everything turned upside down. Although, according to the general concept of our chronology, first there was the Nativity of Christ, and then the new time.

The tradition of celebrating Christmas is connected with Christmas tree. It used to be placed in honor of this Christian holiday. Until 1917, Christmas in Russia was celebrated before the New Year, as in the whole world. Therefore, the Christmas tree was present until the New Year holidays. It was under it that gifts were placed for children.

After the October Revolution, the new government generally banned the celebration of any Christian holidays, including Christmas. Thus, the Christmas tree has become an attribute of the New Year. It should be noted that the New Year at the beginning of Soviet power was not even a day off. Only in 1935, on the initiative of P. Postyshev, children's New Year's holidays began to be held. New Year became a holiday only in 1947.

The beginning of the birth of the New Year holidays in Russia can be called the Decree of the Government of the already independent Russian Federation of 1992 on the transfer of holidays. Then the second of January was made the second day off.

In 2005, for the first time, the Government combined several days to celebrate the New Year. Together with Christmas, the days off made up a whole week. Further, given the different transfers of holidays falling on weekends, the authorities made the New Year holidays traditional.

For the New Year holidays, Russians in 2019 will traditionally rest for many days, namely 10 days. Let's see where they came from:

In order to ensure that weekends and holidays are not interrupted by one working day, the Ministry of Labor decided:

Make December 29 a working day, and move the day off to December 31. Thus, continuous New Year holidays will be obtained from 12/30/18 to 01/08/19.

  • From 12/24/18 to 12/29/18, our citizens will have to work a long working week. At the same time, December 29, 2018 will be made a shortened working day.
  • From 12/30/18 to 01/08/18 - New Year holidays will be held, including a holiday - Christmas.

Summing up, we can say that the Government of the Russian Federation presented our citizens with another gift - new long winter holidays.
