Who is considered a single mother under the law of the Russian Federation

There is no legal definition of a single mother. But you can focus on the decision of the Supreme Court No. 1, single mothers, within the meaning of this norm, can be attributed to a woman who is the only person who actually exercises parental responsibilities for the upbringing and development of her children (relative or adopted) in accordance with family and other legislation, that is, raising them without a father, in particular, in cases where the father of the child has died, is deprived of parental rights, is limited in parental rights, has been declared missing, incapacitated (partially incapacitated), for health reasons cannot personally raise and support the child, is serving a sentence in institutions, executing a sentence of deprivation of liberty, evades the upbringing of children or the protection of their rights and interests, in other situations.

What you need to do to get the status of a single mother:

Do not have written confirmation that the man is the father of his child;
Do not have a valid court order “to establish paternity”.

What documents confirm the status of a single mother

The mother is obliged to provide any of these papers to the registry office when submitting documents for registering her baby. If no confirmation of paternity is presented, then in the column "father" of the state birth certificate of the child, the employees of the registry office put a dash. Mom, when issuing a certificate, is given a certificate in form No. 25, confirming the fact that she is single.

In 2019, the state will continue to take measures social protection regarding single mothers. As before, women raising children without a father will be entitled to various benefits and allowances. Payments and benefits will not change in January 2019, although some increase can be expected from February. Read more about the types of state support for single mothers below.

What payments are due to single mothers in Russia in 2019

A single mother raising a child is entitled to all types of payments, benefits and allowances that are provided by the state for complete families. The amount of each payment in 2019 will depend on how many children she has, on the fact of employment and some other circumstances.

Almost all payments and benefits do not depend on the official recognition of the status of a single mother.

For reference! You don't need to be a single mom if you think it will qualify you for higher benefits.

The amounts and types of payments and benefits are contained in the Federal Law of May 19, 1995 No. 81-FZ. This regulation sets out the payments to which the child and mother will be entitled both this year and next:

  • child care up to 1.5 years;
  • when taking in other people's children (child);
  • for the birth of a child;
  • for timely registration with a medical organization;
  • on pregnancy and childbirth.

At the same time, some types of financial assistance from the state are not available to single mothers. This is due to the fact that the law makes certain payments and monetary compensations dependent on the status of the father. So, for example, families where the father of the child is a military man are entitled to additional payments this year.

Some single mothers misunderstand their position. The conditions for obtaining the status of a single mother raising children in an incomplete family are indicated in the table below (no changes are planned for 2019 yet).

Condition single mother status

The woman is divorced from the father of the child, does not receive alimony -
The woman is not married, the father lives separately from the family -
The child was born no later than 300 days after the divorce -
The father of the child was deprived of parental rights -

For information: 300 days after a divorce is the deadline set by family code RF for formal determination of paternity. If children are born during this period, for example, 5 months after a divorce, then the father will be recorded ex-husband. If the children are born later, for example, after 10 months, then paternity will be established from the words of the mother.

Single mother: benefits, allowances and payments in 2019. There are many reasons for a woman to raise a child alone, but despite the different reasons, the result is the same: mother and child need help.

Who is a single mother?

A woman is recognized as a single parent

whose father is not registered in the document on the appearance of the child.

Other signs of a single mother:

  • the paternity of a particular citizen has not been established by the courts, on the basis of evidence, in particular the results of a DNA examination, that is, there is no judicial determination on this issue;
  • after a divorce between spouses, more than 300 days have passed;
  • there is no statement from both parents during the procedure for registering a newborn in the registry office;
  • a woman who carried out the procedure for the adoption of a child, at this time, without being in a marriage union;
  • children appeared in a woman who at the time of their appearance was not in a registered marriage.

Important! Many mistakenly believe that if a woman divorces the father of her children, then she can legally be considered a single mother, this is not so. When she was left alone with the children as a result of a divorce, it means that a certain person is in the paternity section of the documents for the birth of children. And this factor no longer gives the right to call her a single mother, even if the father after the divorce does not take part in raising children.

The status of a single mother is not assigned

  • a divorced woman who does not receive alimony;
  • a woman who gave birth to a child within 300 days after the divorce (the husband is automatically considered the father);
  • if the father was established in court, but for some reason does not live with the family;
  • if a woman gave birth to a child after 300 days after the death of her husband;
  • if the father is judicial order devoid of genus. rights.

During the registration of the child in the civil registry offices, the woman is issued a certificate in the form No. 25, she confirms that the mother is the only parent.

The surname of such children is assigned to the mother, and in the father column, at the request of the woman, a dash is put down or the information that she provides is recorded.

The status of a single mother is retained if a woman is married, but her husband has not adopted her child

If a woman married, but the husband did not adopt the wife's child, then the employee does not lose the status of a single mother (Article 423 of the Labor Code of the Russian Federation, clause 11 of the Regulation approved by the USSR Council of Ministers of August 12, 1970 No. 659). In this case, legally, the woman remains the only person who must raise the child. In one case, the court indicated that the woman has the right to count on the material assistance of the new spouse and his care for all family members (appeal ruling of the Moscow City Court dated September 16, 2014 in the case No. 33–21339/14). However, in this case, the court convicted the employee of hiding a number of family circumstances from the employer and abusing her right. Therefore, it is not known what decision the court will make in a labor dispute. In a more recent decision, the same court upheld the employee (appellate ruling of the Moscow City Court dated April 18, 2016 No. 33 - 12918/2016). In this regard, the employer risks that the employee will be reinstated at work.

Documents to get single status

To obtain single mom status, you need to contact the department of social protection of the population by registration with a certain list of documents. These documents include:

  • a statement written by a woman demanding that she obtain this status;
  • documents confirming the birth of children;
  • passport of the applicant - mother of the child;
  • a certificate stating that the child lives with his mother, and not with his father or with another person (can be ordered at the passport office);
  • documents showing the applicant's income for the last three months;
  • certificate in form No. 25, a decision of a judicial authority or other document confirming the fact that this person belongs to the category of single mothers.

After that, the resulting number was divided by 730 (this figure was indicated in the law).

If the amount of daily wages received was less than 1.901 rubles. 37 kopecks, which means that the resulting figure must be multiplied by 140. There are a number of cases in which the court definitely recognizes a woman as a single mother. These include situations where the father of the child:

  • not indicated in the birth certificate or information about him was entered from the words of the mother;
  • died or was declared missing;
  • deprived of parental rights and restricted in parental rights;
  • declared incompetent or partially incompetent.

If there is a dash in the child’s birth certificate in the “father” column or information about the father was entered into the document from the words of the mother, then the courts consider the woman to be a single mother (Review of the Supreme Court of the Russian Federation for the 1st quarter of 2010, approved on June 16, 2010, appeal decision of the Smolensk Regional Court of July 3, 2012 in case No. 33-2018). In the second case, a woman needs to obtain a certificate from the registry office that the record about the father of the child was made from her words (form No. 25, approved by Decree of the Government of the Russian Federation of October 31, 1998 No. 1274).

Unfortunately, a single mother is a common occurrence both in modern Russia and throughout the world. There are many reasons for a woman to raise a child alone, but despite the different reasons, the result is the same: mother and child need help. Assistance to single mothers from the state is expressed as follows: additional child allowances and payments, benefits in labor and tax legislation, a preferential queue when applying to a kindergarten, and much more. You will learn more about all the rights, benefits and benefits in 2017 for single mothers in this article.
